COLUMBIA, S.C. (AP) ? South Carolina has hired Frank Martin to revitalize its basketball program.

School trustees approved the six-year contract worth more than $2 million a year on average Tuesday morning. Martin is expected to be introduced by the school later.

The former Kansas State coach will take over a team that finished dead last in the Southeastern Conference last season.

Martin advanced to the NCAA tournament four times in five years at Kansas State. His Wildcats reached the regional finals in 2010. His overall record as a head coach is 117-54, and he is 6-4 in the NCAA tourney.

Facebook, senator blast bosses for asking for passwords

Employers and colleges that demand Facebook passwords or other access to social network profiles are doing more than violating the First Amendment, as advocates argue. They're also violating Facebook's terms of service.

Almost three weeks after Bob Sullivan of msnbc.com's Red Tape Chronicles first broke the story of government agencies and colleges demanding inappropriate access to Facebook accounts, both the social network and a U.S. senator are calling shenanigans on this violation of privacy, which is also a potential liability problem for the inquiring institutions.

On Friday,?Erin Egan, Facebook's chief privacy officer on policy, was direct?and referenced the possibility of legal action.

The practice of requesting Facebook passwords and other access to user profiles "undermines the privacy expectations and the security of both the user and the user's friends," Egan said in a statement on the social network's privacy page. "It also potentially exposes the employer who seeks this access to unanticipated legal liability."?

As an example, Egan?posited, "if an employer sees on Facebook that someone is a member of a protected group (e.g. over a certain age, etc.) that employer may open themselves up to claims of discrimination if they don't hire that person."

Egan went on to say,?it is now a "violation of Facebook's Statement of Rights and Responsibilities to share or solicit a Facebook password."

On Wednesday,?Sen. Richard Blumenthal D-Conn. told Politico?he's writing a bill that would outlaw the practice as well:

The senator cited longstanding federal prohibitions against administering polygraph tests to potential employees as a rationale for a new law.

Even for prospective employees who voluntarily surrendered account access to improve their chances of landing a job, Blumenthal said there remain concerns. "The coercive element of the request," he said, "really makes it less than voluntary."

ACLU attorney Catherine Crump had stronger words for the practice. "People are entitled to their private lives,"?she said in a statement. "You'd be appalled if your employer insisted on opening up your postal mail to see if there was anything of interest inside. It's equally out of bounds for an employer to go on a fishing expedition through a person's private social media account."

Here are some of the egregious examples of Facebook privacy violations,?first reported by Sullivan on March 6:

In Maryland, job seekers applying to the state's Department of Corrections have been asked during interviews to log into their accounts and let an interviewer watch while the potential employee clicks through wall posts, friends, photos and anything else that might be found behind the privacy wall.

Previously, applicants were asked to surrender their user name and password, but a complaint from the ACLU stopped that practice last year. While submitting to a Facebook review is voluntary, virtually all applicants agree to it out of a desire to score well in the interview, according Maryland ACLU legislative director Melissa Coretz Goemann.

Student-athletes in colleges around the country also are finding out they can no longer maintain privacy in Facebook communications because schools are requiring them to "friend" a coach or compliance officer, giving that person access to their ?friends-only? posts. Schools are also turning to social media monitoring companies with names like UDilligence and Varsity Monitor for software packages that automate the task. The programs offer a "reputation scoreboard" to coaches and send "threat level" warnings about individual athletes to compliance officers.

As well as likely violating the First Amendment, such practices also herald legal problems for the institutions, noted Bradley Shear, a Washington D.C.-lawyer who first brought these cases to the attention of Maryland polticians and the ACLU. As an example of liability, he told Sullivan:

"What if the University of Virginia had been monitoring accounts in the Yeardley Love case and missed signals that something was going to happen?? he said, referring to a notorious campus murder. ?What about the liability the school might have?"

Following scrutiny by the ACLU, Maryland state legislators proposed two separate bills aimed at banning social media access by schools and potential employers, Sullivan reported. At the time of the original story, a Facebook spokesperson wouldn't specifically address the state legislation except to say that many of these school and employer policies appear to violate the site's terms.

Though it was more than two weeks in coming, a?definitive?statement and action from Facebook against such privacy violations is in the social network's best interest, more so than the interests of its users. Allowing the practice ?to continue means more organizations will feel free to make password demands, making users feel increasingly less comfortable sharing their personal information via Facebook. Less sharing on Facebook means less personal info for targeted marketing, which is the social network's bread and butter.?

As Facebook continues to make us more comfortable with less and less privacy, this may be one of the few cases where everybody benefits from the social network's pro-sharing business model.?

Simon Johnson: Fiscal Affairs: Last Ditch Attempt to Save a Little Bit of Investor Protection in the U.S.

As it currently stands, the "JOBS" bill now before the Senate would gut investor protection in the United States. The title of the bill is a complete misnomer -- anything that weakens investor protection makes it more risky to invest in companies and increases the cost of capital to honest entrepreneurs. (For more background on the bill and links, see this piece.)

Much of the 1930s-era Securities legislation, which served us well for more than 70 years, is about to be repealed in a moment of bipartisan madness.

Almost all attempts to amend the House version of this legislation -- and to make it more favorable to investors -- have now failed in the Senate, and the "cloture motion" received more than 60 votes (so the bill cannot be filibustered). But Senator Jack Reed (D., Rhode Island) is leading one last charge to make the Senate version more reasonable.

Here is the issue with H.R. 3606 (as the House version of the bill is known), from Senator Reed's website:

The SEC requires public companies to disclose meaningful financial information to the public. This provides a common pool of knowledge for all investors to judge for themselves whether to buy, sell, or hold a particular security. Only through the steady flow of timely, comprehensive, and accurate public information can people make sound investment decisions. The result of this information flow is a far more active, efficient, and transparent capital market that facilitates the capital formation so important to our nation's economy. H.R. 3606 would roll back key investor protections, denying the public critical information that is essential to make sound judgments and would ultimately not lead to the proposed goal of the bill: providing for access to capital, particularly for small emerging companies.

The "JOBS" bill would permit even very large companies to avoid all public disclosures.

Amazingly, it would also exempt these companies from having to comply with the federal regulation regarding mergers and acquisition. Private equity firms would even be able to manipulate the market while making a tender offer for shares -- the kind of behavior that has really been taboo (and illegal) since the 1930s.

Senator Reed has put forward an amendment, #1931, that will at least partially retain some of our existing investor protections and disclosure requirements.

Specifically, Senator Reed's amendment would close or limit a major loophole that will allow large companies to avoid registering with the SEC (and therefore escape much regulation). The Reed Amendment would clarify how to define "shareholders" for the purpose of determining if a business is so widely owned that it must register with the SEC. Under the Amendment, the count should be based on beneficial owners of the shares, i.e., real people. The goal is to prevent evasion of the SEC registration threshold through "nominal" owners holding the shares for large numbers of beneficial owners.

Big companies like H.R. 3606 - they will be regulated less and if the cost of capital rises for start-ups, that actually helps them. The Chamber of Commerce, the American Bankers' Association, and the Independent Community Bankers of America have all weighed in heavily against the Reed Amendment - the idea of escaping SEC scrutiny greatly appeals to them.

The Chamber of Commerce's letter against the Amendment to Senators closes with this statement - or you might call it a threat (bold and underlining in the original):

The Chamber strongly opposes this amendment and may consider including votes on, or in relation to, this amendment in our How They Voted scorecard.

Under Senate rules, the Reed Amendment would need just 51 votes today in order to pass. But against this kind of corporate firepower, does this entirely reasonable Amendment have any chance?

Branding for Writers: An Essential Step to ... - The Creative Penn

Branding is something I think about a lot, especially the personal branding that authors have to consider today.

It?s not an easy process to create a brand.

We are complex people and our writing may span different genres. We also have other facets of life that are important, so how do we combine it all into a coherent brand?

To help develop their readership, many writers want to jump right into blogging, social media, and various other means of engaging others. Now, I am a huge fan of these tools because they connect people in powerful ways. But, for a writer who hopes to grow their career based on these interactions, I often find that they jump in a little too soon, that their are key elements of their own message and purpose that need to be worked out first.

Branding is communication

Enter: branding. I know, it?s a scary word; doesn?t it just send shivers up your spine?

I totally understand why the word ?branding? can make you cringe: you don?t want to be a brand, you want to be a person; you don?t want to market to others, you want to connect with like-minds; you don?t want to become a product, you want to create art. I 100% agree on each of these things.

To me, branding is not about any of those things, it is about communication. Effectively understanding your own purpose, that of your audience, and the ways to connect the two. That?s it, just a word to describe a much deeper and more meaningful process.

I teach a course for writers on how to develop an author platform, and we don?t get to the topic of actually joining social networks and creating blogs until halfway through the course? Why? Because you need to get the basics down first: identifying your goals, defining your purpose, and understanding who you are trying to reach. It?s in that second one, defining your purpose, where branding is born.

If you can?t clearly communicate your purpose, then how can you engage a readership?

I recently spent three months digging into what my own brand means. I worked with others, did tons of thought writing on the topic, it honestly felt a lot like therapy. But what I worked away with was a clear understanding of why I do what I do, of how my work helps others reach their goals, and the language by which to connect the two. But it did so much more than that. Every decision is helped by understanding my brand. The font to use in a presentation, the look of my videos, photos of myself, the places I need to be, etc.

Companies often have what they call a ?brand book,? or ?brand bible.? It is a document that they go back to again and again that helps ensure not just that they are consistent, but that every element of their company works to a common purpose. It is why companies known for their exceptional branding or customer service are so consistent in their high quality. Why nearly every experience with Zappos is effortless, and at times, delightful; why nearly every experience at Disneyworld is surprising and pleasant; why the Apple Store seems more like a gathering place than an electronics store.

As you develop your brand as a writer, here are some things to consider:

Embrace that you are a writer.

This may sound basic, but many writers have a hard time embracing that identity. They see themselves as a writer only after the definitions of their day job, role in their family, etc. When speaking about your work, own that identity of being a writer.

Speak clearly.

Every word counts. ?Too many writers clutter up their purpose with divergent messages. They try to represent every aspect to who they are, to hope they will be. What happens is that the core message is lost. This happens everywhere from one?s Twitter bio, to their About page, to how they introduce themselves to an agent at a writing conference. The more words you remove from your description of your purpose, the stronger the words that remain become.

Be focused.

Few people want to be pigeonholed, but when you are just starting out, when you are still developing that core audience ? err on the side of being specific. Focus the topics you discuss, the audiences you target, the way you describe your work. Too many writers feel that their work should appeal to everyone. And while this may happen, some day, build your way up to that. Focus.

Create core messages you will go back to again and again.

Determine the best ways to communicate your purpose and describe your writing. This helps you to determine what it is, and what it isn?t, and ensures that various people hear the same message. It also lets you hone and evolve how you describe your work.

The value of repetition.

This is branding 101: repetition helps people remember what you are about. Many writers are a bit sheepish to even say once what their work is about, let alone repeat it over time. Never take for granted that many folks are learning about your work for the first time. You are always in the process of helping people learn about the power of your work, about your viewpoint as a writer. Don?t assume people know, repeat those core message when in situations to meet new people.

Tell your STORY, that in and of itself engages people.

Yes, your writing is the key here. But don?t forget that your story as a writer is part of what engages people. How your purpose extends to the work you create. Shape your story as it relates to your work, and share that when you meet people or on the About page of your website.

All of this is about surfacing your purpose as it relates to your writing, your goals, and your audience. This goals beyond surface level interests or demographics. Far too many authors begin and end their purpose, their brand, with vague statements that could apply to thousands of writers. They settle on broad genre definitions instead of really personalizing their brand and considering how it connects with others in meaningful ways.

Branding is connection

In the end, this is about connecting your work to readers who will appreciate it most. In one form or another, this is about story. When you consider your identity as an author, consider framing your own story, of using elements of branding to help communicate this more effectively to potential readers.

'Sneakerheads' rush for shoes for cred and profit

(AP) ? They are lined up in the freezing rain, waiting patiently, stubbornly. All night. All for a few pairs of shoes.

Sean Rivera is among the 60 or so die-hards on this sidewalk along Chicago's Magnificent Mile shopping district. He looks a little crazy, smiling and squinting through fogged glasses.

But the 28-year-old college counselor doesn't care. He's used to being judged like that, used to "being criticized by peers and family members and neighbors," he says, laughing.

It's all part of the life of "sneakerheads," people who spend hundreds, even thousands of dollars on shoes, many of which carry the name of professional basketball stars, past and present.

Chicagoans proudly point out that it started here with Michael Jordan and his Nike Air Jordan brand.

Rivera figures he has about 50 pairs of sneakers at home in his closet. His parents bought him his first pair of Air Jordans when he was a toddler. He carries a picture on his cell phone of his pint-sized self, wearing those very shoes. "You can see the striking resemblance," he jokes, holding the phone with the photo next to his cheek.

In the 1990s, he and many fledgling sneakerheads used to scrape together whatever money they had and then cut class to go buy the latest pair of Jordans. Back then, news reports occasionally surfaced, telling of people who were mugged for their shoes.

Today, that fervor is growing again, fueled by online social networking, and by shoemakers such as Nike that now often limit the number of pairs they release to generate more interest.

Jesus Estrella, a blogger who has become a self-made sneaker guru on YouTube, filmed one recent melee outside a mall in Orlando, Fla.

"This shoe game officially has gone bananas," Estrella, who is known as "JStar" in the sneakerhead community, said as he watched police arrive and then begin sending people home.

That riot and similar ones in other cities were so raucous that some stores postponed their release of new shoes. The most sought after that night was the Nike "Galaxy Foamposite," a $225 pair of shoes made popular by former NBA player Penny Hardaway.

You don't always know which shoe is going to be "the shoe" of the ones that are released, Estrella says.

But often, the shoes that go the quickest are those that are "reissued" ? new versions of old standards, including Air Jordans and the Nike "Mag" sneakers worn by the character Marty McFly in the movie "Back to the Future."

Consignment shops and online auctions have seen some of those shoes resell for thousands of dollars, while others sit on shelves longer and sell for less. A pair of original Air Jordans in good condition ? bought by the most serious collectors ? can sell today for $4,000 to $5,000. "Back to the Future" Mags, originally released to raise money for the Michael J. Fox Foundation and Parkinson's research, go for that much, or more.

Meanwhile, Rivera recently sold a pair of LeBron James "South Beach" Nikes, which he bought for $170 in late 2010, for $900.

"People try to finance their (shoe) habit," says LaVelle "V-DOT" Sykes, who owns a Chicago shop called Overtime, where he and his staff sell sneakers on consignment.

"They'll say, 'I'm going to 'rock' one pair and sell two," he says, referring to people who wear one pair and try to find buyers for the others.

"You see moms, pops, aunties, all kinds of people, across all color lines."

Often, though, sneakerheads are young men in their teens, 20s and 30s, many of whom now use the Internet to show off their "kicks," as they call their shoes.

And companies like Nike are using that instant, word-of-mouth communication to their benefit, marketing experts say.

"When I started in this business back in the '60s, there was no such thing as a blogger," says Michael Carberry, a former advertising executive who is now a marketing professor at American University in Washington.

Now, he says, bloggers are a key advertising component: "They talk it up: 'Did you hear about the new Nike that's coming out? . You gotta be there.'"

Limiting the supply ? a tactic sometimes called "artificial scarcity" ? also fuels the demand in an age when young people are bombarded with products and looking for ways to stand out.

"It's harder and harder to make yourself different and distinct. Everybody has access to the same stuff," says Gary Rudman, president of California-based GTR Consulting, which tracks the habits of young people.

"They're constantly trying to update the brand called 'Me.'"

They do it with anything from clothes to electronic devices or even video game skills. For sneakerheads, it's all about showing off your shoes to gain credibility with your peers, he says.

Dina Mayzlin, an associate professor of marketing at Yale University, refers to this dynamic as "social signaling" ? associating yourself with a hard-to-get brand to build status.

So companies are, in turn, limiting access to a product or service to create a buzz and reputation of coolness.

She and her colleagues have, for instance, studied Google and Spotify, an online music service ? both of which have initially made some services available to consumers by invitation only.

"It's a bit of a puzzle ? why would the company early on try to slow down the adoption of their product?" she says.

She found that the goal for Google, with Google+, or Spotify was to eventually try to draw in even more members who wanted what the initial members had.

When you factor in what it costs to design and promote the limited edition shoes, Nike may not make as much money on them as it would if they were mass produced, Carberry says.

But the publicity they generate is priceless for the brand. "The buzz is what works for them and it just enhances the aura of Nike," he says ? and, in turn, generates more overall shoe sales to those who might not be able to afford a limited edition pair, but still want to attach themselves to the brand.

Because of the chaos it has created, some have questioned whether Nike has gone too far with its limited edition shoes and hyped releases. A Nike spokesman did not respond to questions about whether the company is looking for ways to avoid the mayhem created by recent shoe releases. But in February, the company did issue a statement stressing the importance of "consumer safety and security."

To cut back on crowds, some stores already hand out a limited number of tickets to consumers before a shoe release. Without a ticket, you can't enter the store.

Estrella, the blogger and YouTube sneakerhead, says there is little doubt that the recession is contributing to the havoc because more people are looking for ways to make a fast buck. But he thinks most sneakerheads are in it for more than that.

It's about fashion and sports, he says. It's about friendship and having a common interest.

"For me, it's like I'm wearing art on my feet," he says.

It's much the same for the sneakerheads who lined up in Chicago, and who speak with pride about their extensive shoe collections.

Some talk with a bit of disdain about newer sneakerheads, whom they accuse of only being in it to try to make money. But Sykes, the consignment shop owner who is a longtime sneakerhead himself, doesn't.

"Americans are opportunists. This is the land of making something from nothing. And then people complain about it?" he says.

"Would you rather that a kid resell shoes, or sell drugs?

"I'd rather he stand in line and sell shoes."
